Andrea Kott And Joseph Comer Secure Dismissal Of A Federal Civil Rights And State Law Class Action Lawsuit

Joseph Comer and Andrea Kott recently secured dismissal of a federal civil rights and state law multi-party class action lawsuit brought by more than a dozen plaintiffs against multiple physicians and hospitals around the country. The plaintiffs had alleged that the defendant physicians conspired to improperly revise dosing guidelines for a drug that treats a rare disease. Mr. Comer and Ms. Kott represented a Chicago area physician and hospital in the suit. They pursued dismissal of the case, along with their co-defendants, for lack of personal jurisdiction in the federal district court where the case was brought. The complaint, and an amended complaint, were dismissed and the dismissal is now final. This strategic attack on the pleadings resulted in dismissal for the defendants before litigation costs had mounted.
