Appellate Victory: Joseph Comer Obtains Favorable Opinion From The United States Court Of Appeals For The Seventh Circuit.

Joseph Comer recently obtained an appellate victory in the United States Court of Appeals for the Seventh Circuit on behalf of his client, a Chicago area physician. The underlying matter was a federal civil rights multi-party class action lawsuit brought against multiple physicians and hospitals. The plaintiffs’ allegations related to their refusal of important medical care for newborns that they had refused. Mr. Comer and Andrea Kott had obtained dismissal of the underlying suit in federal district court because the defendants, private physicians, could not be deemed to be state actors as a matter of law. Mr. Comer briefed the appeal on behalf of his client and participated in oral arguments before the 7th Circuit, which then affirmed the dismissal on appeal.
