Krista Frick Achieves Favorable Result for Healthcare Providers in Recent Appellate Win

Barker, Castro, Kuban & Steinback Partner Krista Frick recently secured a win for healthcare providers in the First District of the Illinois Appellate Court regarding an alleged failure to admit a minor suffering from a drug overdose.

A 17-year old woman was treated at Oaklawn hospital for a drug overdose and then discharged. The next day she died from a subsequent overdose. The hospital and three emergency room physicians were sued for alleged negligence and breach of standard of care because the patient was reportedly not admitted or held after being treated for her initial drug overdose.

Krista defended against the appeal, which involved unique issues surrounding expert witness qualifications, speculative opinions and written interrogatories. The Court rejected the plaintiff’s arguments that the hospital deviated from the standard of care, thus affirming the judgment of the trial court.
